KABXI SERVICE TERMS AND CONDITIONS

THIS DOCUMENT IS AN ELECTRONIC RECORD IN TERMS OF INFORMATION TECHNOLOGY ACT, 2000 AND RULES THEREUNDER AS APPLICABLE AND THE PROVISIONS PERTAINING TO ELECTRONIC RECORDS IN VARIOUS STATUTES AS AMENDED BY THE INFORMATION TECHNOLOGY ACT, 2000.
Welcome to Kabxi! These Terms and Conditions (“Terms”) govern your use of the Kabxi mobile application (the “App”) and its services. By accessing or using the App, you agree to comply with these Terms.
1. Definitions
“Company” refers to Kabxi Booking Private Limited.
“User” refers to any individual who downloads, registers, and uses the Kabxi App.
“Driver” refers to independent cab drivers operating through the Kabxi platform.
“Self-Drive Rental” refers to vehicles rented for self-driving purposes without a driver.
“Booking” refers to any ride or rental reservation made via the App.
2. General Terms
These Terms govern your access, interaction, or use of the Platform. By using this Platform, you acknowledge that you have read and understood these Terms and agree to be bound by them.
If you do not agree with these Terms, please do not access the Platform.
These Terms expressly supersede prior agreements or arrangements with you.
The Company may amend these Terms at any time at its sole discretion.
3. Registration and Account
Users must register an account with accurate personal details.
Users are responsible for maintaining the confidentiality of their login credentials.
The Company reserves the right to suspend or terminate accounts for any misuse or fraudulent activity.
Users must be at least 18 years old to register an account.
Users agree to provide only true, accurate, current, and complete information.
The Company may verify user information and suspend or limit access if identity validation is unsuccessful.
4. Booking and Service Usage
Bookings can be made for city rides, outstation trips, or self-drive rentals.
The Company does not guarantee the availability of vehicles at all times.
Users must verify vehicle and driver details before commencing a ride.
Self-drive rental users must provide valid identification and a valid driving license.
The Company reserves the right to cancel or modify a booking under special circumstances (e.g., safety concerns, law enforcement directives, etc.).
5. Payments and Refunds
Users must pay for bookings via the App using approved payment methods.
Payment for self-drive rentals must be made in advance.
Kabxi may charge additional fees for waiting time, tolls, and other applicable charges.
Refunds for canceled bookings: City Rides & Outstation: Refunds are issued based on the cancellation policy.
Self-Drive Rentals: Refunds may be subject to cancellation fees.
Refund processing may take up to 7-10 business days.
The Company is not responsible for failed payments due to third-party payment providers.
The Company is not liable for disputes between the user and the payment provider.
6. Cancellation Policy
Users can cancel bookings via the App.
Cancellation charges may apply based on the timing of cancellation: Before vehicle dispatch: No charge.
After dispatch but before arrival: Partial charge.
After vehicle arrival: Full charge.
Self-drive rental cancellations must be made at least 24 hours in advance to avoid penalties.
7. User Responsibilities
Users must adhere to traffic laws and safety regulations.
Any damage to self-drive rental vehicles due to user negligence must be compensated.
Users must maintain cleanliness inside the vehicle and respect drivers.
Misuse, fraudulent activity, or harassment of drivers may lead to account termination.
Users must not resell or transfer their account to a third party.
Users must not engage in illegal or fraudulent activities through the App.
8. Liability and Disclaimers
The Company acts as an intermediary platform connecting drivers and passengers; it does not own or operate vehicles (except for self-drive rentals).
The Company is not liable for personal injury, lost belongings, or disputes arising between users and drivers.
Self-drive rentals are provided on an “as is” basis, and the Company is not responsible for mechanical failures beyond routine maintenance.
The Company does not guarantee uninterrupted service availability and is not liable for delays, technical failures, or force majeure events.
The Company is not responsible for service quality provided by third-party drivers.
9. Privacy Policy
Personal data is collected and used in accordance with the Privacy Policy.
The Company may share user data with law enforcement if required by law.
Users consent to receive communication via SMS, email, or phone calls regarding bookings and updates.
The Company may track user location for service functionality, subject to user consent.
10. Termination and Account Suspension
Users violating these Terms may have their accounts suspended or terminated without prior notice.
The Company reserves the right to deny access to services at its discretion.
The Company may terminate or suspend a user’s account if fraudulent or suspicious activity is detected.
If an account is terminated, outstanding dues must still be paid by the user.
11. Amendments and Modifications
The Company may update these Terms at any time.
Continued use of the App after modifications constitutes acceptance of the revised Terms.
12. Governing Law and Dispute Resolution
These Terms are governed by the laws of India.
Any disputes shall be resolved through arbitration in Dimapur, Nagaland.
The arbitration proceedings shall be conducted in English.
The decision of the arbitration panel shall be final and binding on both parties.
13. Intellectual Property Rights
The Company owns all intellectual property rights in the App, website, and content.
Users may not copy, reproduce, or distribute any content without prior authorization.
Unauthorized use of Kabxi trademarks, logos, or branding is prohibited.
14. Third-Party Links
The App may contain links to third-party websites or services.
The Company is not responsible for the content or accuracy of third-party services.
Users access third-party links at their own risk.
15. Notices and Communication
The Company may communicate with users via email, SMS, or notifications.
Users must ensure their contact details are up to date.
