Self Drive Rental Terms Conditions

(Compliant with the Information Technology Act, 2000)

Effective Date: 16 March 2025

Welcome to Kabxi Booking Private Limited (“Kabxi”). These Self-Drive Rental Terms & Conditions govern your use of our self-drive vehicle rental services. By booking a vehicle on our platform, you agree to comply with these terms, along with applicable Indian laws, including the Information Technology (IT) Act, 2000, and relevant motor vehicle laws.

This Lease Rental Agreement is made and effective from the date of booking as reflected in the booking details on the App (the “Agreement”)

BETWEEN

The “Lessor” (which expression shall, unless repugnant to the context or meaning thereof, be deemed to mean and include his/her heirs, executors, administrators and assigns) of the ONE PART

AND

The “Lessee” (which expression shall, unless repugnant to the context or meaning thereof, be deemed to mean and include his/her heirs, executors, administrators, and assigns) of the OTHER PART as shall be captured in the booking details;
The Lessor and the Lessee shall be hereinafter collectively referred to as “Parties” and individually as the“Party”.

1. General Terms & Agreement Acceptance

1.1. These Terms & Conditions constitute a legally binding agreement between:
Lessor: Kabxi Booking Private Limited, a registered company under the Companies Act, 2013, operating from Thapo Building, Kirha Village, 3rd Mile, Near Airport Gate, Dimapur, Nagaland, India – 797115.
Lessee: The individual booking and operating the self-drive rental vehicle.

1.2. This agreement is electronic in nature and is legally recognized under Section 10A of the IT Act, 2000.

1.3. Kabxi reserves the right to amend these terms at any time. Continued use of the service implies acceptance of modified terms.

2. Eligibility & Documentation

2.1. Age Requirement:
Minimum 24 years for four-wheelers.
Minimum 21 years for two-wheelers.

2.2. Documents Required (As per IT Act, 2000 & Motor Vehicles Act, 1988):
Valid Driving License issued by an RTO in India.
Government-issued ID proof (Aadhaar, Passport, Voter ID, etc.).
Local Address Proof (if applicable).
Credit/Debit Card or Bank Details for security purposes.

2.3. The Lessee must submit digital copies of required documents, which will be stored securely in compliance with Section 72A of the IT Act, 2000 (Data Privacy & Protection).

3. Vehicle Booking & Payment

3.1. Rental Payment:
Full rental amount must be paid upfront before delivery.
Additional charges apply for excess mileage, late returns, damages, or policy violations.

3.2. Security Deposit:
A refundable security deposit may be required based on the vehicle category.
The refund is processed within 7 working days, subject to deductions (if any).

3.3. Cancellation & Refund:
No cancellation fee if canceled before the start time.
Partial refund for unused rental period (after deducting the used period).

4. Vehicle Usage Policy

4.1. Permitted Use:
Personal use only.
Travel within the designated rental area.

4.2. Prohibited Use:
Commercial use (e.g., ride-sharing, transporting passengers for hire).
Racing, off-roading, towing, or unlawful activities.
Driving under the influence of alcohol or drugs (strictly prohibited).
Carrying hazardous materials, pets (unless permitted), or illegal substances.

4.3. Mileage Tracking:
Distance traveled is monitored via GPS tracking.
Any attempt to tamper with the GPS device will result in immediate termination of rental and forfeiture of deposit.

5. Vehicle Delivery, Return & Inspection

5.1. Delivery & Pickup:
Available during office hours (8:00 AM – 6:00 PM).
Home delivery available at extra cost (subject to location).

5.2. Condition Check at Return:
The Lessee must return the vehicle in the same condition as received.
Interior Cleaning Fee applies for excess dirt, stains, spills, or unhygienic conditions (charged based on professional cleaning quotation).

5.3. Late Return Policy:
An hour late return fee will be applicable as per the latest tarrif.
Beyond 6 hours: An additional full day’s rental will be charged.

6. Insurance, Accidents, & Liability

6.1. Insurance Coverage:
Vehicles are insured as per the Motor Vehicles Act, 1988.
Insurance does NOT cover: Reckless driving, racing, over-speeding.
Accidents caused by an unauthorized driver.
Driving under the influence of alcohol/drugs.

6.2. Lessee’s Responsibilities in Case of Accident:
Inform Kabxi immediately with photos/videos of the incident.
File an FIR at the nearest police station if required.
Submit a Motor Vehicle Inspector (MVI) report for insurance claims.

6.3. Liability for Repairs:
For damage below ₹50,000: Lessee pays for repairs.
For damage above ₹50,000: Covered under insurance unless claim is denied.
Insurance claim denied? Lessee must bear the full repair cost or pay the IDV in case of total loss.

6.4. Vehicle Downtime Charges:
If the vehicle is in the garage for repairs due to an accident caused by the Lessee, a downtime charge of 50% of the daily rental rate per day will be applicable.

7. Data Privacy & GPS Tracking

7.1. GPS Tracking & Dashcam Usage:
Vehicles are equipped with GPS tracking and dashcams for safety.
Tracking data may be shared with authorities in case of legal disputes or accidents.

7.2. Personal Data Protection (IT Act, 2000 – Section 72A):
Kabxi collects and stores personal details (ID, address, payment details) securely.
Data is not shared with third parties unless required by law.

8. Termination & Blacklisting Policy

8.1. Kabxi reserves the right to terminate rental and blacklist users if:
Fake documents are submitted.
The Lessee is involved in illegal activities using the vehicle.
The vehicle is not returned within the agreed period.

8.2. Legal Action:
If the vehicle is not returned within 12 hours of lease expiry, Kabxi will file an FIR for vehicle theft under IPC Section 378.
If Lessee damages or tries to sell/mortgage the vehicle, Kabxi will take legal action under IPC & IT Act, 2000.

9. Dispute Resolution & Jurisdiction

Arbitration: Any disputes will be resolved under Arbitration & Conciliation Act, 1996.
Jurisdiction: Courts of Dimapur, Nagaland shall have exclusive jurisdiction.

Legal Disclaimer

This agreement is digitally recognized under the IT Act, 2000, and all electronic communications, including OTP verifications and digital agreements, are legally binding under Indian law. By accepting these terms, the Lessee agrees to comply with all conditions and is fully liable for any violation.
