Driver Terms Conditions

KABXI DRIVER TERMS AND CONDITIONS

This Cab Driver Terms and Conditions document (“Agreement”) is an electronic record under the Information Technology Act, 2000, including the Information Technology (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2023 (IT Act 2023).


This Agreement is made between Kabxi Booking Private Limited (“Kabxi,” “Company,” “We,” “Our,” “Us“) and Drivers (“Driver,” “You,” “Your“).
Kabxi Booking Private Limited is a private limited company with its registered office located at:
Thapo Building, Kirha Village, Airport Rd, 3rd Mile, Dimapur, Nagaland 797112

By registering, downloading, or using the Kabxi Driver App, You acknowledge that You have read, understood, and agree to be bound by these Terms and Conditions. If You do not agree, do not sign up or use the platform.

1. REGISTRATION AND ONBOARDING


1.1 Driver Eligibility
You must be at least 24 years old with a valid commercial driving license issued by the RTO.
You must have at least 2 years of commercial driving experience with a clean driving record (no major traffic violations, criminal offenses, or driving under the influence in the past 3 years).
You must have an active mobile number (postpaid or prepaid) and a smartphone (Android or iOS).


1.2 Required Documents
The following documents are mandatory for onboarding:
a. Driving License
b. Aadhaar Card
c. PAN Card
d. Residential Proof (Utility Bill, Ration Card, or Rental Agreement)
e. Vehicle Registration Certificate

f. Permit
g. Insurance Certificate
h. Pollution Under Control Certificate
I. Vehicle Fitness Certificate
l. Bank Account Details/Cancelled Cheque


Kabxi reserves the right to verify and approve/reject driver applications based on document validity, background checks, and compliance with legal and safety regulations.

2. USE OF THE KABXI DRIVER APP


By downloading or using the Kabxi Driver App:
You agree not to copy, modify, or distribute any part of the app, trademarks, source code, or intellectual property.
You must not attempt to extract the source code of the app, translate it into other languages, or create derivative versions.
You must not jailbreak or root your phone, as this may compromise security and affect app performance.
Kabxi reserves the right to update or modify the app at any time, with or without prior notice.
The app requires an active internet connection (Wi-Fi or mobile data). Kabxi is not responsible for app malfunctions due to connectivity issues.
If your device runs out of battery power, Kabxi is not liable for any loss of service.
You must install all app updates when provided to ensure proper functionality.

3. DRIVER RESPONSIBILITIES


3.1 Professional Conduct
The Driver shall provide the Service in a professional, courteous, and safe manner at all times.
The Driver must not engage in verbal or physical arguments with passengers or other drivers.
Smoking, drinking alcohol, or using drugs while on duty is strictly prohibited.


3.2 Vehicle Condition & Maintenance
The Driver is responsible for ensuring the vehicle is clean, well-maintained, and roadworthy at all times.
The Driver must renew all vehicle-related documents, including RC, insurance, PUC, and permits.
The Driver must obey all traffic laws and ensure that all statutory vehicle documents are up to date and available for inspection.


3.3 Trip Completion & Fare Collection
The Driver must accept and complete rides as assigned by the app.
The Driver shall not solicit or accept rides outside the Kabxi platform.
The Driver must collect the correct fare from the passenger as displayed in the app. Kabxi is not responsible for any unpaid fare if the driver fails to collect the full amount.
Overcharging beyond the app fare is strictly prohibited.


3.4 Ride Cancellations & No-Shows
The Driver cannot cancel a ride after accepting it without a valid reason.
If a Driver cancels a ride without valid justification, a ₹100 cancellation fee will be applied, which will be deducted from the Driver’s wallet. The Driver may appeal the charge to Kabxi Support if they believe the cancellation was due to extenuating circumstances.
If a customer no-shows after 10 minutes, the ride may be canceled, and a waiting charge (if applicable) will be levied.


3.5 Wallet & Earnings
The Driver’s wallet must maintain a minimum balance (MWB) of ₹500.
If the wallet balance falls below ₹100, the Driver will not receive new ride requests until the balance is replenished above ₹500.
Drivers can request payouts once the wallet exceeds ₹500.
Payouts take 1-3 working days to process.
Cash Payments: If a passenger pays in cash, the Driver must ensure the correct amount is collected. Kabxi’s platform fee will be deducted from the Driver’s wallet balance. The Driver is responsible for ensuring sufficient balance remains in the wallet to continue receiving ride requests.
Online Payments: If the passenger pays via online methods, the fare will be credited to the driver’s wallet after deduction of the platform fee.

4. COMPLIANCE & PENALTIES


4.1 Driver Ratings & Performance
Drivers must maintain a minimum rating of 3.5 stars.
If a driver’s rating falls below 3.5 stars, their account may be temporarily suspended or permanently terminated.
If a driver’s rating falls below 4 stars, retraining is mandatory before account reactivation.


4.2 Violations & Fines
Fake trips (completing trips without a passenger): ₹500 fine.
Unpleasant behavior, arguments, or abusive language towards passengers: Immediate suspension.
Making unauthorized personal stops: Trip cancellation and penalty.
Failure to maintain personal hygiene or vehicle cleanliness: Warning and possible suspension.
Attempting to contact passengers after drop-off without their consent: Account termination.

5. PRIVACY & DATA PROTECTION (IT ACT 2023)


Under the Information Technology Act, 2023, Kabxi ensures:
Driver data is securely stored and not shared with third parties except as required by law.
Kabxi monitors platform activity for safety, fraud detection, and policy enforcement.
